Terms and Conditions

1. Acceptance of Terms

By accessing or using the Tangle Network website, applications, or any associated services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you must not access or use the Services. Your continued use of the Services constitutes your acceptance of and agreement to be bound by these Terms, as they may be amended from time to time.

2. Modification of Terms

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. Any changes will be effective immediately upon posting the revised Terms on the website. It is your responsibility to review these Terms periodically. Your continued use of the Services after any modifications indicates your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue your use of the Services immediately.

3. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction (whichever is greater) to access or use the Services. By using the Services, you represent and warrant that you meet this eligibility requirement and that you have the legal capacity to enter into a binding agreement. All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, and compilation thereof, are the exclusive property of Tangle Network or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from the Services without our prior written consent.

5. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of information as described in our Privacy Policy.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the Services in any medium; (b) using any automated system, including robots, spiders, or scrapers, to access the Services; (c) transmitting spam, chain letters, or other unsolicited communications; (d) attempting to interfere with or compromise the system integrity or security of the Services; (e) collecting or harvesting any personally identifiable information from the Services; (f) using the Services for any illegal or unauthorized purpose; (g) impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity; or (h) interfering with the proper working of the Services.

7. No Investment Advice

Nothing contained in the Services constitutes investment, legal, tax, or other advice, nor should any content on the Services be relied upon in making any investment or other decision. You should obtain independent advice before making any investment decisions. We do not endorse, recommend, or make any representations with respect to any investment, token, digital asset, or financial product. Any decisions you make based on information found on the Services are made at your own risk.

8. Assumption of Risk

You acknowledge and agree that there are inherent risks associated with using blockchain-based systems, decentralized networks, and digital assets, including but not limited to: the risk of loss of digital assets; the risk of software vulnerabilities or bugs; the risk of regulatory changes; the risk of hardware, software, or internet connectivity failures; the risk of malicious software or hacking; and the risk of loss of private keys. You assume all such risks and agree that we shall not be liable for any losses or damages arising from these risks.

9. Regulatory Compliance

You are solely responsible for ensuring that your use of the Services complies with all applicable laws and regulations in your jurisdiction. The Services may not be available in all jurisdictions, and we make no representations that the Services are appropriate or available for use in any particular jurisdiction. You are responsible for compliance with all local laws, including but not limited to export and import regulations, tax laws, and financial regulations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Tangle Network, its affiliates, directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; (c) any content obtained from the Services; or (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

11. Indemnification

You agree to defend, indemnify, and hold harmless Tangle Network, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including but not limited to any use of the Services' content other than as expressly authorized in these Terms.

12. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the applicable arbitration authority. The arbitration shall be conducted in English, and the arbitral award shall be final and binding upon both parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the applicable jurisdiction for the resolution of any disputes not subject to arbitration as set forth above.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, while preserving the intent of the original provision. If such modification is not possible, the relevant provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and Tangle Network concerning your use of the Services. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services. No waiver of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
